Web Site Usage

  1. This site is owned by Wakari Limited (Company Registration No. 5957089) of 38 Winterton Gardens, Sheffield, S12 4NA.
  2. These terms may be changed by us at any time. They can only be modified with our written consent. The current version will appear on this site and will apply each time you use our site.
  3. Your use of this site implies acceptance of these terms. If you do not accept them please do not use our site.
  4. You must not misuse this site or our systems. You must not disrupt the operation of this site or attempt to bypass security systems in place. The use of computer software to access any data held on this site, hacking or virus insertion is strictly prohibited.
  5. Data held in secure password protected areas is for the sole use of our technical staff and individual clients and is deemed privileged information and may not be accessed or distributed by any unauthorised user.
  6. Any links to third party web sites are made in good faith. We cannot guarantee the technical aspects of these links and make no judgment as to the content of these sites. The links are for your convenience only. We make no recommendation as to their suitability and you must make your own decisions when accessing them.
  7. You are responsible for ensuring that your computer system is compatible with our site.
  8. To access the secure client areas of the site you must register with us and at our discretion we will issue you with a user name and password by e-mail. Lost passwords will be replaced by e-mail to the last registered contact point for your user name.
  9. Each registered user must provide accurate and complete details for registration. It is your responsibility to protect your password. The security of your data depends on you. You must notify us if you discover a security breach of your area. We do not accept any liability for misuse or loss of your password or user name caused by any occurrence outside our direct control.
  10. Data held in secure areas is entered by and maintained by our clients ("Third party events"). It is their responsibility to ensure it is complete, honest, truthful and decent. We cannot be held liable for errors or omissions of fact. We reserve the right to remove any data we feel is in breach of the rules and disable any user password without notice or explanation. Our decision on these matters is final.
  11. Whilst we take every care in the storage of data we cannot guarantee that data is free of viruses or rogue coding data that may corrupt it. From time to time we will update this site to include improvements and essential maintenance. Access to the site may be restricted at these times without liability. This maintenance will be carried out at times of least traffic to minimise this disruption.
  12. Our systems rely on third party service providers and the internet. We cannot guarantee universal access to these services and shall not be liable for any loss caused or cost incurred by you as a result of any third party failure that prevents us processing your requests.
  13. It is the sole responsibility of each client to ensure that the event details are accurate, that the details comply with all relevant misrepresentation legislation. We are not liable for incorrect or incomplete data transmitted to end users due to inaccurately entered event information.
  14. We do not seek to exclude any liability that may arise from our negligence that results in death or personal injury.
  15. Subject to clause 13 we shall not accept any liability for any direct or indirect loss, consequential loss, depletion of goodwill or reputation or corruption or loss of data held by us.
  16. The storage of personal details including telephone numbers and contact data is held by us under the terms of the Data Protection Act 1998. Our registration number is Z9682993. We may pass this data to our clients or any third party approved by us as part of our usual business dealings. If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect, how we use it and in what circumstances we disclose it.
  17. English Law shall apply at all times to these terms and conditions. The courts of England shall have exclusive jurisdiction in all legal matters arising from use of and access to our web site.
  18. All legal notices are to be served to our registered office for the time being: Wakari Limited, 38 Winterton Gardens, Sheffield, S12 4NA. Any notices we serve will be by e-mail to the registered e-mail address on your contact page, or by post to your registered office.

Sale of Tickets

As an authorised ticket agent, Wakari Limited sells tickets on behalf of the venue, promoter or producer that produces the event for which you buy a ticket. We refer to the venue, promoter, or producer from whom we obtain tickets to sell to you as our "Event Organiser". This ticket remains the property of the Event Organiser and is a personal revocable license which may be withdrawn and admission refused at any time upon refunding the printed purchase price. The purchaser represents and warrants that the ticket is purchased for personal use only, and that it is not purchased as part of any form of business or commercial activity (save as expressly authorised by the Event Organiser and its agents), and in particular, that the ticket may not be resold or offered for resale by anyone whether at a premium or otherwise and may not be used for advertising, promotion (including contests and sweepstakes) or for any other trade purposes. Resale or attempted resale at a price higher than that printed herein is grounds for seizure or cancellation without refund or other compensation. This includes, for the avoidance of doubt, any publication via the internet or any other means with the intent to resell for commercial gain. The Event Organiser and its affiliates, successors, or assigns may enforce these terms in accordance with the provisions of the Contracts (Rights of Third Parties) Act 1999 (the Act). Except as provided above, this agreement does not create any right enforceable by any person who is not a party to it under the Act, but does not affect any right or remedy that a third party has which exists or is available apart from that Act.

Tickets advertised by us by way of our web sites at www.webticketing.net and by way of official advertising literature produced on our behalf (our "Official Advertisements") are sold by us, namely Wakari Limited (Company Number 5957089) are being sold on an agency basis, to you on the following basis:

  1. Contract

    1. Wakari Limited sells tickets on behalf of events, promoters, teams, bands and venues which means Wakari Limited does not set the ticket prices or determine seating locations. Policies set forth by our clients, such as events, venues, teams and theatres, prohibit us from issuing exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets.
    2. We are entitled to refuse any order placed by you.
    3. We will notify you over the telephone or in writing or by online confirmation if we accept your order and that acceptance will be deemed to have been effectively communicated to you when we make that communication to you (whether or not you receive such communication). Such acceptance remains subject to the condition that tickets are available for the events selected by you until such time as tickets, with the confirmed seat numbers written on them, have been issued to you.
    4. No order will be accepted until we have received payment of the whole of the price of the tickets that you order.
    5. By accepting your order we bring into existence a legally binding contract between ourselves and you.
    6. Tickets advertised on this web site or on our Official Advertisements are advertised by us as agents for a third party. If this is the case:-
      1. the placing of an order by you by whichever means will constitute your consent to our passing on such details to the third party; and
      2. your tickets will inform you on whose behalf we are acting as agent and with whom your contract is made.
    7. If you are ordering tickets which you have seen advertised by us on our web site, by contacting us and placing an order, you confirm that you have read and accept the terms and conditions of the use of our web site shown elsewhere on our web site which relate to the material and information displayed on our web site.
    8. When ordering tickets on our web site, the web site will not prevent you from making infeasible bookings such as tickets to two different events at the same time. If an erroneous booking is made, a refund will not be given in any circumstances.
  2. Price and Dispatch

    1. The price payable for the tickets is as set out on our web site.
    2. Tickets will normally be available for collection at a designated location prior to the event, in which case you must collect the tickets from the address at the time advised, and provide proof of ID. Under some circumstances events may decide to distribute tickets via post or other methods, in which case only the card billing address supplied will be used for dispatch.
    3. Tickets may not be dispatched immediately where we are acting as an agent on behalf of a promoter and that promoter gives alternative instructions about the dispatch of tickets. However, you will be given notification of dispatch once you have ordered your tickets.
    4. Once you have received your tickets, you should check them and you must inform us of any errors within two working days, or before the event, whichever is sooner.
  3. Events

    1. The taking of photographs or the making of recordings (on any format) of the event is expressly forbidden (unless it is expressly permitted in writing by the promoter, the venue and the performer). You consent to the filming and sound recording of yourself in the audience.
    2. Wakari Limited, the Management of the venue at which the event is taking place and/or the promoter of the event each reserve the right to:
      1. refuse admission to you;
      2. request latecomers to await admission to the event until a convenient break in the event;
      3. refuse re-admission to those leaving during the event; and
      4. request that you leave the event;
      5. make alterations to the advertised details of the event (including Principals) and make alterations to the script or the content of any particular event at any time up to and including and during the event.
    3. If, at any time during the event it is cancelled, postponed, suspended or delayed for any reason, Wakari Limited will not make any refunds nor will they be liable for any loss caused by such cancellation, postponement, suspension or delay.
    4. It is your responsibility to ascertain whether an event has been cancelled and the date and time of any rearranged event. If an event is cancelled or rescheduled, we will use reasonable endeavours to notify ticket holders of the cancellation once we have received the relevant authorisation from the Event Organiser. We do not guarantee that ticket holders will be informed of such cancellation before the date of the event.
    5. Tickets are issued subject to the Rules and Regulations of the venue or Event Organiser. Full details are available from the Event Organisers. Breach of any of these Rules and Regulations or any unacceptable behaviour likely to cause damage, nuisance or injury shall entitle the venue or Event Organiser to eject you from the venue.
    6. The Event Organisers may on occasions have to conduct security searches to ensure the safety of the patrons.
    7. We will not be responsible for any tickets that are lost or stolen.
    8. The venue, Event Organiser and Wakari Limited accept no responsibility for any personal property.
    9. Tickets may be restricted to a maximum number per person, per credit card and, for some events, a restriction may apply per household. We reserve the right to cancel tickets without prior notice purchased in excess of this number.
  4. Special Circumstances

    1. In relation to tickets sold by us for events whereby we are acting as an agent for a third party who will be the promoter or the venue at which the event is held ("the Third Party"):-
      1. Such tickets are subject to the terms and conditions of that Third Party, which you are advised to check as they may vary, and, in the particular case of outdoor events, may include restrictions on barbecues, picnics, tents or umbrellas;
      2. You must contact the Third Party to obtain information and arrangements for traffic approaches, parking and for information relating to access for those ticket purchasers/ticket holders who are disabled. We make no representations or warranties that any such information provided by us in this regard is accurate, complete or up to date and we expressly exclude all liability for any such representations made by our employees or representatives in this regard;
      3. No tickets sold by us acting as agents for a Third Party can be exchanged, refunded or returned except with the express authority of the Third Party, which may be subject to an administration fee;
      4. If, prior to the commencement of the event, the event is cancelled or postponed to a later date, we will contact you and any refunds will be made by the Third Party only, unless the Third Party makes such monies available to us; the face value of the ticket only will be refunded;
      5. Where the event is scheduled to take place out of doors, you should assume (unless notified otherwise) that the event will not be cancelled or postponed in the event of inclement weather conditions;
      6. Information provided by us in relation to tickets for restricted viewing seats may not be accurate and complaints should be addressed to the Third Party prior to or during the event; Wakari Limited expressly exclude all liability for any representations made by our employees or representatives relating to restricted viewing tickets in circumstances where a Third Party is involved.
  5. Liability

    1. No liability is accepted in relation to the tickets advertised or sold by us as agents for a Third Party or for any aspect of the relationship between you and that Third Party.
    2. Although we will do our best to correct our errors and omissions on our part as quickly as practicable after being notified of them, we do not accept any liability for any errors or omissions, howsoever caused and we reserve the right to change information, specifications and descriptions of listed events at any time.
    3. We do not accept liability for any losses or claims arising from any inability to access our web site or any failure to complete a booking on the web site or with our bookings office.
    4. We do not accept any liability for any indirect or consequential loss of any kind in contract, tort or otherwise arising out of the use of the web site or the purchase of any tickets or other goods or services from us by whatever means.
    5. We will only be liable for direct loss (save in the case of death or personal injury arising from negligence) up to a maximum total of the price of the tickets or other goods or services purchased in respect of any claim.
    6. Nothing in this clause 5 is, however, intended to limit any rights you may have as a consumer that may not be excluded by law.
  6. Security on our web site

    1. Our web site uses industry standard encryption software and a stand alone secure server to make sure the safety of orders placed on our web site. No-one can access any information sent by you as long as it is sent using the secure pages. Therefore, you must only send credit card details where asked for on our web site and you must not send credit card details by standard e-mail.
    2. Any losses incurred or sustained by customers of our web site who transmit information by means of e-mail or other internet links shall be borne solely and exclusively by that customer and in no event shall any such losses in whole or in part be borne by us. If you are using a public computer or a computer which others may use, you must sign out of it when you have finished making purchases on our web site.
    3. We will not accept any liability for tickets or other goods and services which have been ordered through our web site using your credit card by someone not authorised to do so.
  7. Privacy

    1. By disclosing your personal information to us using our web site or over the telephone or otherwise, you consent to the collection, storage and processing of your personal information by us in the manner as set out in this clause 7.
    2. Information about you including (but without limitation) your name, address, telephone number, e-mail address and credit card details is recorded on a computer database controlled by us. The information is needed to process the transaction and fulfil your order and in the case of subsequent problems or disputes. We may also use the information for internal administration and analysis and the information may be used by us and our associated companies to contact you about events and products. We disclose your information (other than your credit cards details which are never disclosed to third parties by us) to third parties on occasion but only for the purposes of completing your transaction with us or, where we are acting as agent on behalf of a Third Party, to enable the transaction between you and that Third Party to be completed successfully. We may also disclose the information for the purposes of associated administration and obtaining professional advice and your information may also be passed to the management of the venue where the event is taking place or the organisers of the event at their request. If your information is passed to a third party, we have no control over their use of your information and accept no liability in relation to the transfer of your information.
    3. We do not sell, rent or trade your personal information to third parties for marketing purposes.
    4. We operate and are registered in accordance with applicable UK Data Protection legislation.
    5. If you do not wish your personal information to be used for contacting you with information, please inform Wakari Limited or check the appropriate box on the order form (if applicable).
  8. Termination

    We retain the right to terminate this contract and/or suspend or terminate our web site and the information published thereon or on our Official Advertisements immediately and without notice to you. In the event of termination the consent given by you shall continue to apply beyond the lifetime of this contract.

  9. Continued Use of our Web site or continued course of ordering tickets by other methods

    We reserve the right to change and amend these terms and conditions from time to time. Your continued use of or access of our web site or continued ordering of tickets by any other method after such change or amendment (without your specific review of our terms and conditions listed on our web site or available elsewhere) shall be deemed to confirm your acceptance of any such change or amendment. It is your responsibility to check these terms and conditions regularly to determine whether any such amendment has been made. If you do not wish to be bound by any revised terms and conditions, you should stop using and accessing our web site or ordering tickets by any other method.

  10. Invalidity

    If any part of these conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

  11. No Waiver

    No failure or delay on the part of any of the parties to these conditions relating to the exercise of any right, power, privilege or remedy provided under these conditions shall operate as a waiver of such right, power, privilege or remedy or as a waiver of any breach by the other party to these conditions.

  12. Force Majeure

    We shall have no liability to you for any failure to deliver or supply tickets or other goods or services you have ordered or any delay in doing so or for any failure to commence or complete any event or for any damage or defect or loss arising from any tickets provided or the execution of any event that is caused by any event or circumstances beyond our reasonable control.

  13. Governing Law

    Our web sites and our Official Advertisements are controlled, produced and operated by Wakari Limited from our offices in the United Kingdom. Wakari Limited makes no representations that the materials and information displayed on or accessible via our web site are appropriate or available for use in other locations and access to them from jurisdictions where their contents are illegal is prohibited. The contract between us and you shall be governed by and interpreted in accordance with English law, and the English courts shall have jurisdiction to resolve any disputes.

  14. Entire Agreement

    These terms and conditions, together with the terms and conditions of the use of our web site set out on our web site and the prices, delivery details and contact details set out on our web site and on our Official Advertisements, set out the whole of our agreement relating to the supply of the tickets and any other goods or services to you by us. These terms and conditions cannot be varied except in writing signed by one of our directors. In particular nothing said by any sales person on behalf of us should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of the tickets, goods or services offered for sale by us. We accept no liability for any such representation being untrue or misleading.
